Criminal Expungement Attorney in Shreveport, Bossier City, Monroe, & Ruston, LA
Are you currently living with a criminal record? If so, then you know that a conviction on your criminal record tarnishes your reputation and can prevent you from moving forward with your life. The information on arrest records is available for everyone to see and can be referenced in an instant. When you go to apply for a job or even housing, they can pull your criminal record and deny your application due to your criminal history.
Expungement is the process of eliminating arrests or convictions from the public view. This means that your criminal record will not show up on background checks. Only particular governmental agencies, licensing boards, and areas of law enforcement would be able to access your record.
Louisiana criminal expungement lawyer Eric Johnson understands how to expunge charges and what steps to take if your criminal history remains visible to the public. Bring your legal issues to us and learn more about how we can clean your record.
How to Keep Your Record Clean
It’s difficult securing a job with a conviction on your record. Criminal convictions can prevent you from being issued a Transportation Worker Identification Credential (TWIC) which disallows you from getting a job on an oil rig along the Louisiana Gulf Coast. It’s also almost impossible to work in retail or banking with theft charges on your record. The presence of DWI/DUI or drug convictions on your record can also impede commercial truck drivers’ ability to obtain a CDL or employment with a trucking company.
At John D. & Eric G. Johnson Law Firm, LLC, we prepare all the necessary paperwork and take the appropriate expungement steps for you. Louisiana laws regarding the expungement of criminal records changed drastically on August 1, 2014. Eric is very familiar with these changes in expungement law which, in most cases, makes criminal record expungement more achievable.
What are Expungeable Offenses in Louisiana?
Expungement is highly beneficial, but it is only available to a limited group of people. Both misdemeanor and felony offenses can be expunged, but the specifics surrounding the incident determine whether or not one can benefit from the expungement process. Existing laws prevent expungement of all records and only allow expungement in certain cases:
Misdemeanors
- Arrested but:
- Never prosecuted
- Charges dismissed
- Acquitted
- Completed diversion program
If you pleaded guilty to the charge and your charge is not exempt from expungement. In most cases, you must wait at least five years after you’ve completed your sentence before you can pursue expungement.
Felonies
- Arrested but:
- Never prosecuted
- Charges dismissed
- Acquitted
If you pleaded guilty to the charge and you charge is not exempt from expungement in most cakes, you must wait at least ten years after you’ve completed your sentence before you can pursue expungement. That is only if you do not have any open felony charges and you have not been convicted of a felony in the ten years after your completed sentence.
